Ready to kill myself! Started 3 months behind with WaMu in 2008. Almost done after trial modification.
Then my counsel fell off face of earth (Calvin Upson, will remember that name till I die). Next my lender refused my payments, then said in underwriting and then I will have permanent modification.
2009 comes and goes, the mortgage is sold off to Chase and paperwork after paper work faxed.
Finally made my payments of $1875/month for year, then threatened by Chase, my lawyer could do nothing for me, they also represent Chase locally, conflict of interest, but told me to make copies of all I sent Chase.
Finally Feb 2011 got trial mod for $2384/month (raised it but want to keep my house). I am at 10.75% adjustable.
They spell our name wrong on our loan paperwork which was signed with WaMu at a McDonald restaurant and predatory lending at its finest.
My stress level has hurt my health, my family, and my job. I cant take it any more. I make payments and have so many fees, and they refused to post anything, so where is the money? Why a raise in payment, on the trial modification, and How do I keep my family home when I can't even talk to anyone at the bank. Always different answers from them every day.
Can I sue them?

Wow this one is a mess. Yes you can sue, anyone can sue anyone else but to be successful you will have to build some grounds for a law suit. If you can do that Chase will deal with you without having to go to court.
Tell Chase To Produce the Note
Start by asking Chase to produce the note. Tell them to send you a copy of the note with all endorsements attached and copies of all mortgage assignments with endorsements. Just follow the steps as outlined in

If they cannot produce the note that shows they own the mortgage you can use that as leverage to get an affordable modification. They need those documents to be able to legally foreclose and will try to foreclose without it if you do not challenge them on the documentation.

If you do qualify for HAMP the terms are simple: Chase will lower the monthly payment to 31% of your gross monthly income and I assure you that the interest rate will be a lot lower than 10.75%, unless your monthly gross income is more than $7,690/month.
